MY CONTRACT IS UNFAIR

My contract is unfair, what can I do ? – we hear this a lot.

As contract lawyers we regularly come across unfair contracts.

Practising in commercial law it is fair to say that we have seen more than our fair share of unfair contracts.

Be they employment contracts, modelling contracts, subcontractor agreements, supply agreements, franchise agreements, leases and even conveyancing contracts – they all can at times be unfair to the party at the detriment of the other.

Unfortunately the imbalance of power between the parties in most cases is such that the contract or agreement is presented almost on a take it or leave it basis. This is a real issue.

Indeed our view is that anyone that presents a contract to you on this basis should make you hear alarm bells ringing!!

In a lot of cases this lack of not being able to negotiate a contract fairly has further meant that people are afraid of losing out on the overall deal and its potential benefits.

In many cases people feel obligated that they go ahead and sign the contract and hope that all will end well and that trust and goodwill will prevail. Blind faith sometimes does work.
